Lawsuit Against Wal-Mart Concerning Plan B Medication

In 2006, three women from Massachusetts filed a complaint against Wal-Mart, alleging that its decision to not stock Plan B emergency contraceptive was illegal.

Following are the primary documents from the case:

Letter sent from Sam Perkins (on behalf of the plaintiffs) to Wal-Mart CEO Lee Scott on December 16, 2005

Response from Wal-Mart Lawyers on January 26th, 2006.

Complaint filed with the Commonwealth of Massachusetts on February 1, 2006

One month later, Wal-Mart decided to carry the Plan B bill, reversing its earlier decision. The decision came after Massachusetts ordered Wal-Mart to carry the product. This article in the USA Today featured Wal-Mart Watch’s response:

“We commend Wal-Mart for taking an important
first step towards allowing women access to safe and legal medication,”
Andrew Grossman, executive director of union-backed campaign group
WalMartWatch.com, said in a statement.

WalMartWatch.com said Wal-Mart should now look
at changing what it claimed were other business practices that harm
women, including inequality in pay and promotions that are alleged in a
class-action federal lawsuit against the retailer pending in San
Francisco.
